Welcome from the Deputy Director-General: Research, Development and Innovation

The Department of Science and Technology (DST) is proud to announce the establishment of the National Intellectual Property Management Office (NIPMO) as a Chief Directorate within the DST, in terms of the Intellectual Property Rights from Publicly Financed Research and Development Act, 2008 (Act No. 51 of 2008) (IPR-PFRD Act). The Chief Directorate is an interim measure until NIPMO is formally established as an independent entity, a process that is expected to take at most 18 months.

 

The IPR-PFRD Act mandates NIPMO as follows:

  • To obtain statutory protection for the intellectual property (IP) referred to, if it is in the national interest;
  • To conclude any IP transactions.
  • To commercialise such IP.

Welcome by Prof. Jonathan Youngleson (Chief Director: NIPMO)

The management of intellectual property (IP) emanating from publicly financed research and   development has become a critical factor in ensuring that the public derives greater returns from the increasingly significant R&D investments made by Government.  In recognition of meeting this imperative, the Government of South Africa introduced the Intellectual Property Rights from Publicly Financed Research and Development Act 51 of 2008  (the IPR-PFRD Act) to provide a regulatory framework for management of such IP.

The National Intellectual Property Management Office (NIPMO) was established in terms of the IPR-PFRD Act with the objective of “Providing for more effective utilisation of intellectual property emanating from publicly financed research and development; to establish the National Intellectual Property Management Office and the Intellectual Property Fund; to provide for the establishment of offices of technology transfer at institutions; and to provide for matters connected therewith.”

Introduction to NIPMO

The management of intellectual property (IP) emanating from publicly financed research and development has become a critical factor in ensuring that the public derives greater returns from the increasingly significant R&D investments made by government.  The South African Government introduced the Intellectual Property Rights from Publicly Financed Research and Development Act 51 of 2008 (referred to as the IPR-PFRD Act) to provide a regulatory framework for the management of this type of IP.

The National Intellectual Property Management Office (NIPMO) was established in mid-2011 in terms of the Act to promote and manage the objects of the Act. These include the identification, disclosure and statutory protection, and management and commercialisation of the IP referred to it by a recipient of public R&D funds. NIPMO has been set up as an interim office within the Department of Science and Technology as a sub-programme within Programme 2 - Research Development Innovation, pending its establishment as a Government Component within a two-year time frame.

All institutions are to submit to NIPMO for approval their institutions’ formulae for calculating their applicable direct and indirect costs of undertaking research and development.
 
The formulae are to be submitted to NIPMO every two years on an IP9 form, accompanied by an explanatory note of how the costing rate was arrived at.
 
The deadline for the submission of Full Cost matrices by institutions was 31 January 2012.

The Japan International Cooperation Agency (JICA) has offered the National Intellectual Property Management Office an ongoing, sponsored training programme in intellectual property rights. On February 2012 five technology transfer professionals attended a JICA training session that looked at patent examination policies and processes, and intellectual property office operations.
